NO MORE LAND OF FIRES
The environmental crimes are now criminal offenses.
Since May 29 last year, Law 68/2015 came into the force, approved in the Senate with the applause, by 170 votes in favor, 20 against and 21 abstained.
Until yesterday, the crimes against the environment were merely fines and failures observed as an environmental precautions that involves only an administrative penalty. Now the new law introduces four new offenses against the environment to the Criminal Code: the environmental pollution crime, the crime of environmental disaster, the traffic offense and abandonment of high-level radioactive material and the control of crime prevention.
With new regulations the statute of limitations for environmental crimes have doubled, while there is a reduction of two thirds of the sentence in the cases of active collaboration, which means, if you prevent a further worsening of the environmental situation, and you are responsible for the remediation and restoration of the state of polluted sites.
For crimes against the environment, the law 68 also introduces the confiscation of proceeds from crime done and used property.
This law was in waiting for over 20 years, supported by trust of 25 organizations led by Legambiente and Libera and represents a civilizational achievement for the country and an important tool for the protection of our environmental heritage.
It is a law that favors a clean economy and rewards the virtuous companies.
